Three Chinese investors are seeking the return of their unlimited immigration permit granted to them in 2014, after two years later, two of them were wanted by Interpol for financial fraud in their country.
Yesterday, the Administrative Court rejected the appeals of all three applicants, finding that they do not have an acquired right to remain in the territory of the Republic and that their stay and in this case, the continuation of the validity of the immigration permits granted to them, was always at the discretion of the Minister of Interior, falling within the sovereign rights of the state.
It is noted that the two applicants are husband and wife and the third is the mother of the husband. In 2013, a mother and son submitted, through a representative, an application for a Category F Immigration permit. The other applicant was included in her husband's application as a dependent person. Their applications were examined by the Civil Registry and Migration Department on 5.12.2013. The presentation of a residence document in Paphos, at the price of €630,000, as well as the fact of the transfer to Cyprus from abroad of the amount of €410,000 were taken into account. They also presented income data, from which it was established that they had an annual income derived from their work in China.
In addition, during the examination of their application, the existence of a clean criminal record certificate issued by the competent authorities of China was taken into account, as well as the fact that the KYP and Interpol, at the time the information was requested (2013), did not possess any information about their person. On 10.1.2014, the mother and son were issued a category F immigration permit, of unlimited duration, without the right to work and leave to the wife as a dependent.
The Chief of Police, in a letter dated 28.9.2016, informed the Civil Registry and Migration Department that on 24.9.2016, a message was received from Interpol, informing that a Red Notice has been issued against the mother and son by the Chinese authorities, as they are wanted for financial fraud. In the meantime, on 24.7.2019, the Agreement on the Extradition of Fugitives between the Republic of Cyprus and the People's Republic of China (Ratification) Law of 2019 was published in the Official Gazette of the Republic, under which the Republic may extradite persons requested from China to be tried for criminal offenses.
Following this development, the Minister of the Interior revoked the immigration permit, while an attempt was made to extradite them to China, but a Court in Paphos rejected the request. The three Chinese nationals appealed to the Administrative Court challenging the decision to revoke their immigration permit, with their lawyer stressing that they have already invested large sums of money and that their license was granted since there was nothing against them.
The Court rejected the defense's positions that in the end the fugitive's application was rejected by the Paphos District Court, since it was out of time, as well as the fact that the facts in question do not have the object of revoking immigration permits, due to conviction, but for reasons of public order and security. "The registration of the fugitive application, as well as its result, did not have, nor does it have any legal value for the way in which the administration could act in relation to the applicants' residence status in the Republic, at the material time," emphasizes Judge Elita Gavriel.
In conclusion, the Court states that it must be said that the granting of an immigration permit to any foreign person falls under the relevant Regulations, within the broad discretion of the Minister of Interior, who, in such cases, exercises a power that goes back to the sovereign nature of the State and touches on the sovereign rights of the Republic, while it is reiterated that the person who submits such an application, It does not have an absolute right to approval, but only an expectation, always observing the principles of good faith.
