ANTI-CORRUPTION AUTHORITY - ACTING OFFICIAL DENOUNCED FOR MISMANAGEMENT OF EUROPEAN FUNDS - THE EUROPEAN PUBLIC PROSECUTOR'S OFFICE TAKES OVER

The investigation into the anonymous complaint submitted to the Independent Anti-Corruption Authority concerning the improper management of European funds by an active official has been terminated.

In a statement issued by the Authority, it is stated that the competent authority for the investigation of possible mismanagement of European Union funds, in accordance with Directive (EU) 2017/1371, is the European Public Prosecutor's Office (EPPO), to which the specific complaint for the appropriate actions was forwarded.

The announcement is as follows

An anonymous complaint was submitted to the Authority, alleging improper management of European funds by an active official.

It is emphasized that the Authority, in accordance with Articles 6(2) and 7(1) (m) (n) of the Law on the Establishment and Operation of the Independent Anti-Corruption Authority of 2022, Law 19(I)/2022 (the "Law"), to investigate and evaluate complaints related to acts of corruption.

Based on Regulation 14(2)(b) of the Establishment and Operation of the Independent Anti-Corruption Authority Regulations of 2022, R.A.A. 483/2022 (the "Regulations") concerning anonymous complaints, such as the present one, it is provided that in the case of examination, evaluation and investigation of an anonymous complaint and/or information, the Authority relies on the evidence before it.

It is provided that, in the event that the Authority considers that the evidence before it is insufficient, it may carry out further investigation to find additional evidence, in order to determine whether the anonymous complaint and/or information can be effectively investigated within the framework of its responsibilities.

It is noted that the competent authority for the investigation of possible mismanagement of European Union funds, in accordance with Directive (EU) 2017/1371, is the European Public Prosecutor's Office (EPPO), to which this complaint was forwarded for the appropriate actions.

Consequently, the process of further investigation of the Complaint by the Authority is terminated.
