On April 22, 2026, the Road Safety (Amendment) Law of 2026 (Law 103(I)2026) was published in the Official Gazette of the Republic, according to which the installation and use of electronic image recording devices in private motor vehicles and in private or public vehicles used for professional purposes will be allowed for specific purposes, as well as government vehicles and vehicles belonging to the wider public sector.

The new legislation will come into force on July 23, 2026.

In particular, the installation and use of electronic image recording devices in the vehicles in question will be allowed, by law, for the purposes of:

(a) protection of the driver in the event of an accident;
(b) documentation of incidents of violation of the Road Traffic Code, causing an accident and/or a criminal act and providing information to the Police for the purpose of investigating traffic offences or accidents and
(c) supervision of fleets of commercial vehicles in the event of a criminal act or causing an accident.

According to the provisions of the new legislation, the use of electronic image recording devices and the optical material produced by them should be carried out in a way that does not violate personal data. Otherwise, it will be possible to impose an administrative fine or penalty, on the basis of the legislation governing the protection of personal data.

Particularly important is the provision that allows the collection and use of video material from electronic image recording devices, by the Police or insurance companies, for the purposes of investigating traffic offenses and/or accidents and criminal acts. It should be taken into serious consideration that the public reproduction or communication of recordings from an electronic image recorder that include persons or the identity of third parties, is prohibited without their consent, while in the case of minors, without the consent of their parents or guardians.

Any recording by an electronic image recorder will not constitute evidence in itself, in the event that a case is forwarded to the Court. Therefore, it will be up to the Court to decide whether any recording will constitute evidence of what is recorded in it.

According to the same legislation, the Commissioner for Personal Data Protection issues instructions regarding the collection and processing of personal data, as well as the permitted use of electronic image recording devices.
