Fourteen years after a traffic accident that occurred in Athienou, a driver attempted to overturn in court the attribution of 80% of the responsibility attributed to him for the collision, however he was faced with a new defeat, as the Supreme Court ruled that his handling on the road was what caused the accident, fully upholding the first instance decision.

The case concerned a lawsuit filed by a female driver at the Larnaca District Court, claiming compensation for bodily injuries and other damages that, as she claimed, she suffered as a result of the accident.

According to the findings of the court of first instance, the accident occurred on April 14, 2012, when the defendant driver, moving on a main road in Athienou, attempted to turn right to a lane. During the execution of the turn, he entered the right lane prematurely and in a circular direction, ending up in the opposite direction of the road and colliding with the plaintiff's vehicle, which was already immobilized just outside the stop line of the lane.

The court of first instance held that the driver acted negligently, as he made the turn from a point where it was not allowed, did not follow a right turning angle and did not make sure beforehand that the lane he was entering was clear. It was also noted that if he had made the turn from the intended point and in the appropriate way, the collision would have been avoided.

At the same time, the court also charged the driver of the immobilized vehicle with joint negligence, ruling that she had not stopped completely before the stop line, but had advanced about 60 centimeters beyond it. However, she considered that her own responsibility was clearly less and attributed 80% of the blame to the driver and 20% to herself.

In his appeal, the driver argued that the responsibility should be attributed in whole or at least 80% to his opponent, citing, among other things, the fact that he was driving on a main road and that the driver was outside the intended waiting position at the intersection.

The Supreme Court rejected these claims, pointing out that the division of responsibility is primarily the task of the court of first instance and that intervention is justified only in cases of manifest error or incorrect application of legal principles.

In its unanimous decision, the Court held that the court of first instance correctly assessed all the testimony and circumstances of the case, taking into account the conduct, actions and omissions of both drivers. As stated in the decision, no error was found in the assessment of the facts or in the application of the relevant case law.

The Supreme Court underlined that the appellant's gross responsibility was fully justified, as his handling during the execution of the turn created the risk that led to the collision. It therefore held that there was no scope to reverse the allocation of responsibility decided at first instance.

The appeal was dismissed in its entirety, while the Court awarded the respondent legal costs of €1,700 plus VAT, if paid.
