With the seal of the Court of Appeal, the acquittal of an estranged spouse for a case of alleged illegal entry into a house in Prodromos was ratified, as it was judged that he retained the right to use the property and no intention to disturb the complainant was proven.

The case concerned a private criminal prosecution registered in 2021 by the complainant against four persons, including his estranged wife. The charges related to illegal entry into foreign property for the purpose of committing an offense or to disturb the holder, as well as conspiracy to commit this offense, for events that allegedly took place in August 2021 in a house in Prodromos.

During the first instance proceedings, the respondent was called to apologize only for the first charge, while the other defendants were acquitted. At the end of the hearing, the Court ruled that the case had not been proven beyond a reasonable doubt and proceeded to acquit the accused, rejecting the testimony of the prosecution as unreliable.

The evaluation of the testimony was of decisive importance for the outcome of the case. The Court of First Instance rejected as unreliable the testimonies of the complainant and his key witnesses, pointing out contradictions and lack of personal knowledge, while on the contrary it considered the testimony of the accused to be reliable. It was accepted that she entered the house in question, exercising a right of use, in the context of a pending property dispute between the parties and without intending to disturb the complainant.

According to the Court's findings, it was not proven that the residence was in the exclusive possession of the complainant, nor that there was an agreement between the parties. On the contrary, it was found that the ownership status of the house remained unclear, while both sides claimed rights of use in the context of proceedings before the Family Court. Under these circumstances, it was held that the respondent had the right to use the house jointly.

The Court of Appeal, examining the four grounds of appeal raised by the appellant, held that they were unfounded. As pointed out in the decision, the appellant's complaints are based on a misunderstanding of the findings of the Court of First Instance and essentially attempt to challenge the evaluation of the testimony, which is not allowed in the context of an appeal against an acquittal decision, which is limited to legal issues.

The Court rejected the claim that the Court of First Instance had incorrectly applied the law in terms of the concept of possession, clarifying that possession is not necessarily the same as property and that, in the present case, sole possession by the appellant had not been proven. At the same time, it ruled that the necessary element of intent to nuisance, which is a basic condition for establishing the offense of illegal entry, was not established.

Regarding individual presumptions and messages invoked by the appellant, the Court of Appeal noted that these were evaluated by the Court of First Instance and were not excluded, rejecting the relevant claim. In addition, it rejected the position that 'lis pendens' before the Family Court automatically created rights, clarifying that the Court of First Instance merely took into account the claim of rights and the relevant testimony.

In conclusion, the Court of Appeal ruled that the first-instance decision was correct both in terms of the evaluation of the testimony and in terms of the application of the law and no legal error was found to justify interference. It therefore dismissed the appeal in its entirety and upheld the respondent's acquittal, while awarding costs in her favour.
