FATAL TRAFFIC ACCIDENT - DEPRIVATION OF A DRIVER'S LICENCE INCREASED TO TWO YEARS

The penalty of deprivation of a driving licence is increased from three months to two years in the case of the offence of causing death due to a reckless act.

The Plenary Session of the Parliament unanimously approved into law the proposal of Mr. Andreas Pasiourtidis on behalf of the parliamentary group AKEL-Left-New Forces, which amends the Law on Motor Vehicles and Traffic Movement, so that, in the case of the offence of causing death due to reckless, reckless or dangerous act or behaviour,, which does not amount to culpable negligence, to increase the maximum period of time that the court may impose for the penalty of deprivation of the right to possess or obtain a driving licence from three months to two years.

As the rapporteur of the proposal explained before the Plenary, for the specific offence with which those who cause fatal accidents are referred to court, the maximum sentence in combination with any other sentence is a maximum of three months. At the same time, he said, if you don't provide a sample of alcohol, he can deprive you of your license for two years, if you don't provide a sample for drugs for three years, and if you complete 16 penalty points, he can deprive you of your license for six months, and if you repeat it over a period of five years, he can deprive you of it for 12 months. If you kill a person and are found guilty, he added, it deprives you of it for up to three months. Obviously, this sentence is not sufficient. For this reason, he noted, with this specific proposal for a law it is increased to a maximum of 24 months with the footnote that this does not mean a priority that all drivers who are convicted will be deprived of the right to hold a license for this period of time.
