TRAFFIC CAMERAS - BILL IS COMING FOR ALTERNATIVE WAYS OF SERVING OUT-OF-COURT- DOCUMENTS

The Ministry of Transport is proceeding immediately with the submission of an amending bill that will provide for alternative ways of serving out-of-court documents for traffic cameras. These are referred to in a joint announcement by the Ministries of Justice and Transport, with which they fire on the previous government.

In detail, the announcement:

The award of the contract for the installation, maintenance and operation of the system, and the start of operation of the entire system took place during the term of office of the previous government.

The service of notifications for violations recorded by the system to the owners of the vehicles is done by the contractor company through registered letter and where and where this is not achieved, it is done with a subsidy of the contractor company, exactly as provided for in the aforementioned contract and the relevant legislation which was also passed before the beginning of the term of office of the current government.

The last amendment in relation to the manner of service of out-of-court documents was voted by this Parliament in 2021.

The current government is doing nothing more than faithfully implementing the provisions of the convention and legislation, as they were in force before taking power in March 2023 and which are still in force.

It is a fact that since the start of operation of the system on 01.01.22 until today, a significant number of undelivered notifications for violations recorded by the system have been collected, something that obviously the previous government and the Parliament had not foreseen. This is due to the fact that vehicle owners do not update their data in the databases, but also to the reluctance of some vehicle owners who, while being notified, do not come to receive the notifications.

The platform for informing the public about the existence of alerts for violations recorded by the system, was created by the current government after, among other things, a request from a significant portion of citizens. This platform is nothing more than an additional helpful tool to facilitate and serve the citizen in order to determine whether a notice is pending against him.

The operation of this platform has also been approved by the Legal Service. This platform is not a substitute for the provisions of the legislation relating to the service of notifications. No one is obliged to visit it, while the visit does not count as a notice of the violation, nor does it count as the beginning of the deadline within which the violation must be paid.

In addition, in order to definitively resolve the gaps in the legislation, which we repeat was voted on earlier, the Ministry of Transport is immediately proceeding with the submission of an amending bill that will provide for alternative ways of serving notifications.

The above are clarified in order to restore reality and truth and in response to the populism, misinformation and misleading of citizens that is observed through public statements by specific party and other factors.
