POLICE - AT THE LEGAL SERVICES FOR EXTRAJUDICIAL PROCEEDINGS

The Police insists on the list of persons for whom out-of-court proceedings are pending from the Traffic Police cameras  being served at airports on arrival/departure and will bring the matter before the Legal Service for clarification.

On the issue, the members of the Parliament's Legal Committee in their last session before the Easter holidays, during which they discussed the issue, sent a message to the Police not to proceed with the so-called photoradar list, i.e. the list of those who did not receive their extrajudicial report for any reason, noting that such a thing is not based on any law.

The Police, however, believe that the existing legislation allows them to carry out checks to determine whether an arrest warrant is pending against a citizen or if there is any other pending case, including the extrajudicial one from the cameras. As is the case with alimony, fines or if someone holds a valid driving licence, or an insurance certificate or MOT, so with fines, it could be possible to check whether it is pending against someone and to be served during the process of leaving or entering the Republic.

According to our information, the Police intend to send a letter to the Legal Service in the coming days announcing its intention to implement the list of individuals for whom an out-of-court case is pending against them from the cameras and will ask for an opinion on whether special legislation is required or whether it is covered by existing legislation.

At the same time, according to our information, the list with the Data Protection Commissioner and the managing company will be updated, so that it can be implemented.

The intention of the Police is that, when a citizen leaves airports or ports, it is checked, as is done today, whether he is on the stop list or on the alert list, to examine whether he is on the list of extrajudicial cameras files. If this happens, then he will be taken to a nearby place, he will be served out of court documents and then he will be able to leave.

The citizen will not be arrested but will be asked to head to another office where he will be served the out-of-court order. In this way, the Police believe that they will be able to reduce the thousands of out-of-court cases pending and at the same time identify those who deliberately avoid receiving them.

A similar list will be applied to the barricades, since those Turkish Cypriots who are denounced cannot now be served.
