A 22-year-old man who was found guilty after a hearing before the Limassol Criminal Court on charges of sexual abuse of a child, sexual exploitation of a 15-year-old, kidnapping and use of cocaine will remain in the cell for two and a half years.
The Court of Appeal dismissed his appeal against his conviction, in which he argued that the 15-year-old's testimony was wrongly accepted and that his friend's testimony had been ignored. In fact, when the father was looking for his daughter, the accused offered to help with the investigations, while the young woman was with him.
According to the judgment, the Criminal Court, after finding the complainant's testimony credible and rejecting the defendant's version in its entirety, reached findings, a summary of which is set out below.
The defendant was then aged 20 and the complainant was 15 years old, they were chatting through messages and the accused liked the complainant. Her parents are separated and at the material time she was living with her grandmother because her sister had been diagnosed with coronavirus. Before the incident in question, the defendant and the complainant had met once more and the defendant had kissed her.
Her father, when he discovered the affair, contacted the defendant by phone and told him to stop seeing his daughter because of the age difference, telling him that otherwise he would report him to the police. On 16.2.2022 at about 00:30, the complainant left the balcony door of her grandmother's house without informing anyone, in order to meet with the accused.
They met at a specific point from where the defendant picked her up in the car, in which R.M. was also a passenger. All together they went to Pelendri where the accused used cocaine in the presence of the minor. In the morning hours, after the defendant had left R.M. at his home, they went with the complainant to his own house. There, in her presence, he used cocaine again. Because he was unable to take her home, they went to his room where he slept.
When the defendant woke up at noon, he took the complainant to her grandmother's house but, because the balcony door was locked, they returned to his house. There, the 22-year-old told the complainant about love and that he loved her and pressured her into lewd acts. He also made various gestures.
The complainant's parents started looking for her after they were notified of her absence from school, and the police were notified. The defendant and R.M. claimed not to know where the complainant was, and even offered to help her parents find her. Eventually, the complainant was spotted by her aunt walking around the Diocese around 8 p.m.
The Court of Appeal rejected both grounds of appeal, finding that the minor's testimony was properly evaluated and did not require corroborating testimony, and taking testimony from his friend would not change anything. The Court of Appeal also rejected the appeal of the Legal Service, which sought an increase in the sentence.

He paid dearly for the indecent acts committed by an exhibitionist last summer in Ayia Napa, where on three occasions he displayed his genitals to tourists. The justification in court was the "hormonal disorders" that the defendant had, an excuse that was not accepted.
The Court of Appeal overturned his sentence from five months in prison and increased it to nine months for the indecent assault charge, and from two months to four months for the indecent act charges.
In the first case, on 30.7.2024 at about 09:00 it was reported at the Ayia Napa Police Station by the complaining A.H. from Slovakia that on the same day at about 06:20 while walking on Kryou Nero Street in Ayia Napa and passing next to an unknown woman, he attacked her. Specifically, while the man was standing on the side of the road, he grabbed her by the shoulder with one hand and with the other pulled down his pants proceeding to an obscene act. The complainant pushed him and he immediately fled.
On 7.8.2024 at about 09:30 it was reported at the Ayia Napa Police Station by B.R. and B.F. that on the same day at about 07:30 while walking on Kryou Nero Avenue in Ayia Napa, a saloon vehicle with only the driver was on board stopped near them. The driver opened the car door and got out, at which point the complainants saw that he had his pants down and was performing an obscene act. The complainants left the place.
On 11.8.2024 at 08:15 it was reported at the Ayia Napa Police Station by I.C.F. and M.S., both from Norway, that on the same day at about 06:07, while they were returning to a hotel on 1st April Street in Ayia Napa, a saloon car approached them. The driver, who was found to be the respondent, exited the vehicle and performed an indecent act. He then attacked one tourist with his other hand, grabbing and pulling her by the bikini top, showing her breasts. M.S. then pushed the respondent with her hands and he got into his vehicle and fled.
According to the Court of Appeal, the respondent's actions caused all the complainants justified inconvenience. They are acts that are an offence against morals. Nor can it be considered a mitigating factor to suggest that the respondent's conduct was due to 'hormonal disturbances' which 'mitigated his self-control and inhibitions'. In a civilised society this cannot be an excuse. In those circumstances, the imposition of a prison sentence on the respondent was inevitable.
Eventually the Court increased his sentence from five months in prison to nine.
