The preliminary objection raised by the lawyer of the German woman, who is accused of usurping Greek Cypriot properties in the occupied areas, was rejected.

The Permanent Assize Court of Nicosia ruled as vague the speculations raised by the 49-year-old defendant's lawyer that no court in the Republic can try her impartially.

In its judgment, the Assize Court cited the ECtHR which had ruled that vague issues of impartiality of the courts raised may be classified as abusive.

"The supreme duty of the Courts," the Assize Court said, "is to protect the constitutional rights of citizens in the Republic. It is the duty of the courts to administer justice without fear and without passion. The preliminary objection that the Court will not have impartiality cannot be accepted," the Assize Court said.
