A coordinated operation to combat illegal stay on the territory of the Republic of Cyprus took place this morning in the districts of Nicosia, Limassol and Paphos.

During the operation, 47 foreigners who were staying illegally in the territory of the Republic of Cyprus were identified and arrested, while the procedures for their immediate repatriation were activated.

Members of the Aliens and Immigration Service and the Subdirectorate for Green Line Surveillance and Migration Flow Response took part in the operation.

Early yesterday afternoon, the Police handcuffed a 34-year-old man from Israel, against whom an arrest warrant was pending.

According to the Assistant Police Director of Operations of ADE Paphos, Michalis Vikolau, an arrest warrant was pending against the suspect for an investigated case of residential burglary and theft of a safe.

Specifically, on January 22, after a burglary and theft that took place at a house in Chloraka, it was established, from the area's closed circuit surveillance, that a person was at the scene in a specific vehicle. Both the vehicle and the suspect himself are linked by testimony that "places them at the scene" as a result of which the authorities proceeded to issue an arrest warrant against him.

It should be noted that in the suspect's luggage, during his attempt to cross into the occupied territories, a number of burglary tools of advanced technology were found and confiscated. Today the 34-year-old will appear before the Paphos Court for the issuance of a warrant for his arrest to facilitate investigations.

Finally, it should be mentioned that the safe that was stolen from the residence had been abandoned.  The TAE of Paphos is continuing its investigations.

The Paphos Police carried out a coordinated operation in the last twenty-four hours, with the aim of preventing road traffic collisions, in the context of which 65 traffic complaints were made, most of them concerning driving at excessive speed.

According to the Assistant Police Director of Paphos Operations Michalis Nikolaou, out of the 65 traffic complaints, 31 related to driving at excessive speed, 1 complaint of driving under the influence of drugs and the rest, minor traffic violations.

The coordinated operations of the Police will continue at a later stage, concluded Mr Nikolaou.

Members of the Pafos Traffic Police stopped a motorcyclist for checking.

It was found that the 35-year-old expatriate was riding a motorcycle that had been reported stolen by its owner. He was also arrested and detained.

A court had awarded €19,500 in damages to a father and his two minor children for violating their right to privacy by a company that runs a water park for using their photos for advertising purposes. The company filed an appeal which was dismissed last Wednesday.

The lawsuit was filed when a family of four had visited the water park for recreational purposes. During their presence there, the parents and their two minor children, without realizing it, were photographed while entertaining on a slide and their photo was widely used for advertising purposes of the business.

In that regard, the Court of First Instance awarded them damages in 2015 for violation of their right to privacy by the managing company. It is noted that there are not many similar cases heard by Cypriot courts.

The management company of the waterpark appealed the first instance decision, while the family's lawyer, Christakis Christakis, filed a cross-appeal, considering the compensation as insufficient.

Eventually the cross-appeal was withdrawn, as was the ground of appeal for high damages. Two grounds of appeal remained, namely that the Court of First Instance erroneously rejected the company's suggestion that minors did not have standing to bring the action.

The reason was that the title of the claim did not state in the indictment that the children were minors and that there was no mention of their mother anywhere in the lawsuit. The Court of Appeal held that where the action has been brought through one parent when it should have been through both, this does not render it inadmissible, but it is an irregularity that can be remedied.

As noted, in the case before us, the question of the representation of minors was not raised in the proceedings at first instance. Since the issue could not therefore be dealt with in the adjudication of the merits of the action, a fortiori, it cannot be dealt with on appeal either.

The second ground of appeal challenges as erroneous the conclusion of the Court of First Instance that the photograph in question was photographed and published without the consent of the father and his two children.

The company's position during the trial was that, on the day the family visited the waterpark, there were warning notices and/or entry conditions at its entrance that photographs would be taken for the purpose of advertising and promoting the waterpark and that members of the public appearing in them would have no claim on the appellant company.

Further, that he ignored testimony that the photographer had informed the respondents who were smiling at him and did not evaluate the fact that the existence of an announcement at the entrance was not disputed by cross-examination by the respondents.

The Supreme Court rejected these positions, saying that the testimony of the company's two defense witnesses referring to these allegations was rejected at first instance, a fact that was not disputed on appeal. For these reasons, it dismissed the appeal, upholding the judgment at first instance.

A new charge will be added to the already heavy indictment pending before the Assize Court in Limassol, against the 44-year-old Syrian, for the quadruple fatality that occurred a few minutes after the advent of 2024.

Philenews reports that at the next trial, the prosecution will add to the indictment another charge of driving at a speed likely to cause damage or bodily harm. The details of the offence will state that the accused was driving his vehicle at an estimated speed of 108 km per hour, which is double the limit on the specific road on which the multiple fatal collision occurred.

The speed of the vehicle involved, as explained to us, was calculated in a scientific way and a key factor was the recording of the vehicle by a security camera. From the time the vehicle is seen until the collision, the duration is measured and analyzed to extract the speed, while other factors are taken into account (lighting, brake signs if any, etc.).

The next hearing in this serious case is set for February 22, when the defendant will be charged with speeding.

The 44-year-old faces the offences of murder (four charges as many as the victims), causing death by reckless, reckless or dangerous act or conduct in violation of Article 210 of the Criminal Code and violation of red and orange lights, to which he is expected to respond.

Arsonists targeted a well-known bar in a central part of Limassol on Archbishop Makarios Avenue.  According to the police, shortly after one in the morning, a fire broke out outside the premises

An OPE patrol noticed the fire and extinguished it using a fire extinguisher before it spread.  The fire caused minor damage to the exterior.

From the first examinations the fire appears to have been set maliciously with the use of flammable materials.  Examinations are ongoing.
