472% INCREASE IN ASYLUM SEEKERS' APPEALS AGAINST THE REPUBLIC OF CYPRUS IN THREE YEARS

The Republic of Cyprus won 71% of the decisions of the International Administrative Court on appeals, registered by foreigners and asylum seekers, in 2023, according to data announced by the Legal Service.

According to the data, the competent sector handled 10,001 new cases in 2023.

From 2020 to 2023 there was a 472% increase in newly registered appeals before the Administrative Court for International Protection. From 2022 to 2023 there was a 9% decrease in newly registered appeals.

One of the responsibilities of the Law Office of the Republic, through the Appeals Subsection of the Administrative Court of International Protection, is to represent and defend the Administration (Ministry of Interior, Asylum Service, Civil Registry and Migration Department), before all competent State Courts, in appeals against the Republic registered by foreigners and asylum seekers.

The contribution of the Legal Service is essential for the management of the large number of cases registered against the Republic in the Courts due to the increased migratory flows in the Republic.

The "Annual Statistical Analysis of the Administrative Court of International Protection and Foreign Appeals Subsection of the Administrative Court, for 2023" shows the volume of work carried out by the Legal Service, with the main conclusions summarised as follows:

  1. For 2023, the Subsector handled a total of 10,001 new cases before the Supreme Court, the Court of Appeal, the Administrative Court and the Administrative Court for International Protection.
  2. Before the Administrative Court of International Protection 8,377 new cases concerning asylum seekers were registered and before the Administrative Court 1,230 new appeals concerning foreigners were received.
  3. In 2023, 9,818 cases were processed before the Administrative Court of International Protection of which only 45 cases have succeeded, i.e. 0.46%.
  4. From 2020 to 2023 there was a 472% increase in newly registered appeals before the Administrative Court for International Protection. From 2022 to 2023 there was a 9% decrease in newly registered appeals.
  5. 76.53% of the appeals registered before the Administrative Court of International Protection concern applicants from safe countries. Applicants from safe countries decreased by 8.14% compared to 2022, while applicants from unsafe countries increased by 7.09%.
  6. Appeals concerning foreigners before the Administrative Court amount to 65.25% of the total appeals received for 2023.
  7. 71% of the decisions of the Administrative Court concerning foreigners were in favour of the Republic while 29% were against the Republic.
