Charges 1-13 were suspended against 44-year-old Joseph Joseph, known as "Sifis", for the attempted murder against Nikos Rodotheou on 26/11/2018 in the center of Nicosia.
This development was finalised this morning at the Nicosia Assize Court, where a hearing was set for the case. The representative of the prosecution, Vasilis Bisas, explained that after the withdrawal of the main prosecution witness (30-year-old A. H.), it is not possible to substantiate charges 1-13 and therefore said that they should be suspended. He also asked for time to handle the case, since now only one charge remains (the 14th). The case has therefore been set for 19 October.
Following the above development, there are no grounds for further detention of the accused as a defendant, as mentioned in the proceedings. As the representative of the prosecution explained, after an agreement on the defense lawyers, the terms of bail were set. Specifically, the defendant will pay the amount of €10,000 and sign once a week at the Lakatamia police station.
We recall that at the previous hearing, 30-year-old A. H. had indicated that he would not testify under oath. As we noted, this was an essential development, as on the basis of the testimony of the same person, Adam Aburamadan and Didi Rudolph were convicted of the same crime with 17 years in prison. Both allegedly had Joseph as an accomplice in committing the crime.
A.H. had said before the three-judge judiciary: "I have to state that I have sent a letter (to the Legal Service) and I do not intend to testify about the case." He explained that "my memory has been damaged and I don't remember the events."
It should be noted here that when on 4/9/2021 the Assize Court found Rudolph and Aburamadan guilty of the same criminal act, namely the attempted murder against Nikos Rodotheos, the testimony of the then 28-year-old A.H. was characterized as key to the conviction of the aforementioned and the resolution of the case.
The prosecution witness, on 06/03/2019 was sentenced to 10 months imprisonment, for complicity after committing the attempted murder. At the time, he was accused of assisting two people in order to enable them to escape punishment. He had been convicted by his own admission.
As he had reported at the time, he made suggestions for third-person complicity. The attempted murder against Nikos Rodotheou (brother of Andros who had been murdered in April 2017) was committed on November 26, 2018, around 23:10 at night in the area of the Hilton Hotel. Two people on a motorcycle fired five shots into the back of the 60-year-old Cypriot businessman's car.
After testimony emerged, the ICF of Nicosia had proceeded with the arrest of three persons, while the Police had announced at the time that two more people were wanted in the case. The reason for Didi Rudolph and Joseph Joseph, a.k.a. "Sif". Both had fled to the occupied areas, with the first being handed over to Cypriot authorities in July 2019 and the second in March 2021.
When Joseph was charged in the present case, his lawyer had raised several issues before the court, which delayed the start of the trial.
