The Supreme Court upheld in its decision the 10-year prison sentence imposed on him by the permanent Assize Court of Limassol, for rape, assault and causing bodily harm and violence to the family.

He is an Egyptian man who has faced charges of 11 counts of raping his estranged wife and assaulting her and their son. As reported to the Court, because his daughter's teacher in Egypt insisted on her FGM, the appellant, along with his family, left Egypt and on 29/12/2019 came to Cyprus, where they applied for asylum. The intention of the appellant, who had been separated from the complainant for 3 to 4 years previously, was to marry a Cypriot woman in order to legalize his stay.

The Egyptian complained in an appeal that his 10-year prison sentence was excessive and that his personal circumstances were not taken into account. The Court of Appeal in its judgment stated that in the present case, the Assize Court noted that the appellant used excessive physical violence against his complaining, estranged wife, forcing her to consent to have unlawful intercourse with him, hitting her on the back, arm, leg and pulling her, events that took place in the presence of their children. but also threatening her that he would take steps with the Immigration Department so that she and their children could return to Egypt, as well as informing her family in Egypt that she was having an extramarital affair.

"All these were rightly judged by the Assize Court as serious aggravating factors for the appellant, as well as the fact that this conduct was repeated and long-lasting, since over a period of one year (between 1/6/2020 and 21/6/2021) he raped the complainant on 11 different occasions and dates, which constitutes a further aggravating factor," the Court notes.

The Court of Appeal rejected the Egyptian's argument that he did not have the perception that he was committing a crime, arguing that rape between spouses is not a criminal offence in his country, after withdrawing it during the trial, arguing that the sexual relations he had with the complainant were also with her consent. Finally, the Supreme Court found that the sentence imposed could not even be considered severe, which is why it upheld his sentence to 10 years in prison.
