APPEAL FILED AGAINST INADEQUATE SENTENCE AS A RESULT OF FATAL ACCIDENT

The 22-month sentence imposed on the 35-year-old Russian driver, who caused the death of the 62-year-old from Hungary, in the fatal accident that occurred in the early hours of December 7, 2022, in Germasogeia, was considered by the Attorney General of the Republic to be manifestly inadequate.

According to reliable information of "F", the Attorney General filed a criminal appeal with the Supreme Court against the first-instance decision imposed by the Limassol District Court against the 35-year-old accused in the offence of causing death by negligence. The same information states that according to the facts of the case which were set before the Court and accepted by both sides, the 22-month sentence imposed is considered manifestly inadequate.

At the same time, legal circles note that it is time to consider amending the law and increasing penalties for fatal accidents. The prescribed prison sentence at this time, is up to four years according to Article 210 of the Criminal Code.

It is recalled that the terrible fatality that took the life of 62-year-old Marta Tyorjanne Tofei from Hungary, mother of two, is among the worst accidents recorded in the Limassol district in recent years. The unfortunate woman died on the asphalt a few minutes after she was torn from work. The accident took place on December 7, 2022 when the 35-year-old's vehicle with a 27-year-old passenger was heading east on Georgiou Vasileos Street. At the junction of Panagiotis Tsangaris Street, the 35-year-old, driving at high speed, did not stop at the red light and collided violently with the vehicle of the 62-year-old who was trying to enter the beach, resulting in instant death. Determinants of the fatal, increased speed in combination with alcohol consumption and violation of a red light.
