The Commissioner for the Protection of Personal Data Irene Loizidou Nikolaidou in a statement regarding the Photo-Labelling System states that on Friday, December 10, 2021, it approved its operation, adding that her Office will continue to monitor the issue and provide guidance where and where it is needed.
In the announcement, the Commissioner informs that her Office has had continuous consultation with the Police and the Contractor who undertook the design and development of the photo-labelling system, in order to ensure that its operation will be in accordance with the Traffic Offences (Use of Photo-labelling Devices and Other Related Issues) Law and the General Data Protection Regulation (GDPR).
She adds that the assistance of her Office concerned all stages of the operation of the system, from taking the photograph of a traffic offence to the payment of the extrajudicial document.
It further clarifies that, among other things, guidance was given for the clear distinction of the roles of the Police and the Contractor as well as his subcontractors, for organizational and technical security measures and for the collection of information for the purpose of identifying the owner of the vehicle or the driver, if the owner designates another person.
It also states that in the context of its obligations under the GDPR, the Police prepared and submitted to its Office an impact assessment for this system and after finding that all comments submitted for guidance were taken into account and that, on Friday, December 10, 2021, it approved its operation.
It adds that on 1 January 2022, it is expected that the issuance of extrajudicial fines will begin, once the relevant processing contracts have been signed and after a final inspection of the system and notes that data collected or to be collected before the signing of the contracts, in the context of tests of the system, will be destroyed.
