EUROPEAN COURT OF HUMAN RIGHTS - 'GREEN LIGHT' FOR COMPULSORY VACCINATION OF CHILDREN

The European Court of Human Rights has ruled that compulsory vaccination is 'necessary in a democratic society'.

This decision came in response to an appeal by parents of children who were not admitted to Czech kindergartens because they were not vaccinated.

"The measures could be seen as necessary in a democratic society," the court said in its ruling, saying Czech health policy was in line with the "best interests" of children. "The goal should be that every child is protected from serious diseases, through vaccination or herd immunity," he added.

Thus, as a result, the court held that there had been no violation of Article 8 on the right to respect for privacy of the European Convention on Human Rights.

This is the first time that the European Court of Human Rights has adopted a ruling on compulsory vaccination against childhood diseases. This decision "enhances the possibility of mandatory vaccination under conditions of the current Covid-19 epidemic," said Nicolas Ervier, a legal expert specialising in the ECHR.

In the Czech Republic, there is a general legal duty to vaccinate children of nine diseases, such as diphtheria, tetanus, pertussis, hepatitis B and measles.

The case was filed in court by Czech parents, who were fined for non-compliance with this vaccination duty or whose children were denied entry to kindergarten for the same reason.
