The Supreme Court ruled that the fines imposed on a law firm by the Cyprus Bar Association were legal, annulling a decision of another court which it ruled as illegal.
This is a fine of €90,000 imposed by the Cyprus Bar Association on a law firm which it convicted in 2022 on nine counts, pursuant to its provisions on the Prevention and Combating of Money Laundering Law of 2007, Law 188(I)/2007.
The company, with its application to a judge of the Supreme Court, secured a sertiorari decree by which it succeeded in the annulment of this decision. The Association secured a license and filed an appeal, where the day before yesterday it succeeded in overturning the first instance decision.
The Association raised the issue of the jurisdiction of the Supreme Court to review its decision, in the context of the exercise of its privileged power under Article 155.4 of the Constitution, of the decisions of the Council in the context of Law 188(I)/2007.
The Supreme Court, composed of three judges, ruled that the Council of the Cyprus Bar Association, as a Supervisory Authority in the context of article 59 of Law 188(I)/2007, is administrative and the administrative Authority can be represented and have a say in the process of reviewing its decisions. By extension, and if the decision of the Council, as an administrative act, is challenged by an appeal to the Administrative Court, it cannot be subject to review by the Supreme Court within the framework of its privileged jurisdiction under Article 155.4 of the Constitution.
It is a decision of the three judges of the Supreme Court that in this case the Court of First Instance issued a certiorari order annulling the decision of the Council dated 3.10.2022, while it had no jurisdiction to do so. Following this development, it annulled the decision by which the fine was overturned.
In a second similar case, the Cyprus Bar Association had imposed a fine of €19,000 on another law firm on the same charge, i.e. the law on the prevention of money laundering. The company reacted and secured the annulment of the decision.
The Bar Association applied for leave to appeal, which it secured to annul the first decision, on the same grounds.
