MANDATORY MOVEMENT OF VEHICLES AFTER A CAR ACCIDENT WITHOUT INJURIES - WHAT THE LEGISLATION PROVIDES, THE FINES AND WHAT DRIVERS NEED TO KNOW

MANDATORY MOVEMENT OF VEHICLES AFTER A CAR ACCIDENT WITHOUT INJURIES - WHAT THE LEGISLATION PROVIDES, THE FINES AND WHAT DRIVERS NEED TO KNOW - Filenews 2/6

With the aim of unloading the road network, especially after light road collisions, the House of Representatives proceeded to amend the Motor Vehicles and Traffic Movement Law, which was published in the Official Gazette of the Republic on April 21, 2026.

With this amendment, drivers are obliged to move their vehicles from the scene of a road collision, under certain conditions.

According to the provisions of the new amendment, drivers involved in road collisions must move their vehicle off-road, to the nearest point, in order not to hinder traffic traffic, as long as the collision has not caused obvious bodily injuries to any person and provided that:

-There is no need for the intervention and/or presence of the Police at the scene
-The vehicles involved can be moved without being towed and without causing further damage, either to the vehicles themselves or to the road surface, and
-It is reasonable under the circumstances prevailing at the moment.

Before moving the vehicles, the drivers involved are required to:

-Inform their insurance company immediately,
-Exchange the necessary information (name, insurance policy number, driver's license number, vehicle details and phone number)
-Obtain photographs of the scene of the collision, which include the motor vehicles in their final position after the collision, registration numbers, damage caused and the surrounding area, and
-Exchange the photos taken and send them to a person indicated to them by their insurance company.

It is noted that failure to comply with the obligations provided for by law constitutes an offense and in case of conviction it results in a fine, which does not exceed one thousand euros (€1,000).

At the same time, a person who induces or coerces or attempts to induce or coerce, in any way, a driver of a motor vehicle involved in the road collision, not to move his vehicle or not to take the appropriate
actions specified by law before moving the vehicle and is subject to a fine not exceeding one thousand euros (€1,000) is guilty of an offense.

When the vehicle is moved, the owner or driver or other person who has responsibility or control of it, is prohibited from parking or leaving it illegally or dangerously or in a way that obstructs traffic.

In case of non-compliance, the legislation provides for the removal of the vehicle by law enforcement, the payment of travel expenses and the imposition of a penalty by the Court: a prison sentence of up to one year or a fine of up to three thousand euros (€3,000) or both of these penalties.

In the event that a driver has moved his vehicle off-road, to the nearest point, due to his involvement in a road collision, from which no obvious bodily injuries have been caused, the Police recommend that drivers consult with their insurance representatives before their complete departure from the nearest point where they have stopped.
