The Court of Appeal unanimously rejected the criminal appeal filed by a man against the Republic of Cyprus, upholding in its entirety the conviction of the Limassol District Court for offences relating to sexual and physical violence. The three-member composition of the court, consisting of Judges M. Abizas, St. Christodoulidou-Messiou and I. Stylianidou, held that there is no reason to interfere with the credibility findings and conclusions of the Court of First Instance.
The appellant initially faced 13 charges for offences committed on the evening of 20 May 2024 in Limassol, against two women, of which nine remained after four were withdrawn. These included charges of assault causing grievous bodily harm, joint assault, assault causing actual bodily harm, indecent assault on a woman, as well as negligent and reckless act.
According to the findings of the Court of First Instance, two women who were in Cyprus on vacation met the accused on the coastal front of Limassol and agreed to board his vehicle. Along the way, the accused allegedly performed sexual acts without consent against one of them, and then drove the car to a secluded spot where he used violence against both. As a result of the attack, one woman suffered, among other things, an acute fracture of the sternum and multiple abrasions and bruises, while the second was injured in the knee when, according to the findings, the accused tried to escape by driving his vehicle towards her and hit her with the bumper.
The Court of First Instance found the accused guilty of all charges, with a differentiation in one of them and imposed sentences of many months in prison, with a longer one of 26 months for causing grievous bodily harm, with the sentences being concurrent.
In his appeal, the convicted person put forward six grounds, mainly challenging the assessment of the testimony of key witnesses for the prosecution and arguing that there were substantial contradictions that created reasonable doubts as to his guilt. The Court of Appeal reiterated that the evaluation of testimony belongs primarily to the Court of First Instance, which has the advantage of direct contact with the witnesses and that intervention is justified only in cases of obvious error or absurd conclusions.
Examining the entirety of the testimony and the arguments of the defense, the Court held that there was no breach in the evaluation or error in the findings. It rejected as unfounded the complaints of substantial contradictions and considered that the conclusions of the Court of First Instance were reasonable and based on admissible testimony. As for the charge of negligent and reckless act, he agreed that the defendant's driving style, in dark conditions and with a sudden start in the direction of an injured person, exceeded the limits of simple negligence and met the elements of the offense. Consequently, the appeal was dismissed and the conviction was upheld.
