The Court of Appeal increased by 18 months the sentence imposed at first instance on a young Syrian for the transfer of 17 illegal immigrants from Syria to Cyprus. The Court of Appeal rejected his appeal against his conviction and sentence, while accepting the appeal of the Attorney General for inadequacy of the sentence and thus the 30 months in prison for assisting a prohibited immigrant became 4 years and the 18 months in prison because he was himself a prohibited immigrant were converted into 2 years in prison, with the sentences being concurrent.
According to the facts of the case, on 8.2.2024, a police boat of the Port Police of the Republic of Cyprus, after receiving a signal at the marina of Ayia Napa, went to check an unknown target and was located, at a specific location at a distance of 6.75 nautical miles southeast of Cape Greco, a boat made of fiberglass 5-6 meters long. There were 18 people on board the boat, 15 men and three minors, all illegal immigrants. When the migrants' boat was spotted, it was adrift. According to what the migrants reported, they come from Syria and departed from Tartus. The engine was broken down and did not work, and there was no fuel. The migrants were helped to board the police boat safely and headed to the Ayia Napa marina where they were picked up by members of the Famagusta Police Department for further action.
As a member of the Coast Guard testified, with 23 years of experience and knowledge, regarding speedboats, a boat that is about six meters long is entitled to carry six people, while eighteen were found on the boat in question. This was dangerous and at any time they could be displaced and the boat could be overturned. The boat was not seaworthy and in this case it was at the mercy of the waves. The conviction of the accused was based on the testimonies of two immigrants who recognized him navigating the boat at least during the day. Also, a photo taken by members of the Coast Guard as they approached the boat with the occupants contributed to his conviction.
The Court of Appeal, which examined the two appeals, rejected all the positions of the convicted person and considered the decision of the Court of First Instance to be correct. As the Court of Appeal noted, the need to impose dissuasive penalties in this type of offense was recently confirmed by the same Court, which is why it agreed with the position of the Attorney General that the sentence imposed on him by the Court of First Instance was insufficient, especially considering the circumstances under which the respondent was found guilty and the role he played in the whole operation.
