STRICTER RULES ON GUN LICENCES FOR PERPETRATORS OF DOMESTIC VIOLENCE

A bill amending the Law on Firearms and Non-Firearms was passed by the Plenary in order to expand the list of offenses whose conviction constitutes an impediment to the issuance of a license to acquire and possess a Category C8 firearm for a period of ten (10) years from the date of conviction and ten (10) years from the date of release.

These offences include violence against women, domestic violence and the production and marketing of industrial hemp.

The bill was prepared at the suggestion of the Chief of Police.

It is worth noting that the Legal Committee accepted a proposal by the Mediterranean Institute for Gender Studies to delete the provision of the law under amendment by virtue of which the Minister of Justice and Public Order is given the opportunity, on the recommendation of the Chief of Police, to reduce the period of ten (10) years from the date of conviction and ten (10) years from the date of release which constitutes an impediment to the issuance of a permit to a person who has been convicted of offences specified in the Domestic Violence Law.

The Committee also decided to delete the proposed provision of the bill by virtue of which the above possibility is provided to the Minister of Justice to allow a person to apply for a license to possess Category C8 firearms, before the completion of ten (10) years from the date of conviction and ten (10) years from the date of his release, in the event that the person in question has been convicted of offences provided for in the Law on the Prevention and Combating of Violence against Women and Domestic Violence and Related Matters.
