The new legal framework for the movement of vehicles after minor accidents may have been implemented in the previous days, but some points have not yet been clarified and remain in a grey area. Undoubtedly, minor accidents often cause unnecessary chaos in the already burdened traffic, especially on main roads, and a solution should be provided.
But a solution that will not put drivers in trouble, who in the end can find themselves exposed due to incorrect procedures they followed.
What seems to dominate in recent days is confusion as to when you can move the vehicle or not, without the presence of a representative of your insurance company.
However, the most important point, which must be clarified so that there are no misunderstandings between citizens, is that the movement of vehicles will only take place if all the drivers involved agree.
That is, if one of the two drivers refuses, then the cars will not be moved and representatives of the insurance companies will be called to the scene, that is, what is happening today.
It would not be an exaggeration to say that this is expected to happen in many cases, since especially the driver who will not be responsible for the accident will want to ensure that in the coming days – due to the absence of an insurance representative or even due to a mistake in the procedure – he will not be called upon to take responsibility for damage for which he is not responsible.
What applies now
In the event of a road collision between motor vehicles on any road, including an open space, a square and/or a public space, provided that the drivers involved consent to the movement of their vehicles and provided that basic conditions are met, the vehicles involved shall be moved to the nearest point in order not to obstruct traffic traffic.
The conditions are as follows:
(a) there must be no obvious bodily harm to any person involved;
(b) no complaint of personal injury and the drivers must have checked their documents and found that they are valid and valid, facts that indicate that there is no need for the intervention and/or presence of the Police at the scene
(c) the vehicles concerned can be moved without being towed and without causing further damage, either to them or to the road; and
(d) to make it possible to move, both in terms of the safety of all road users and in terms of traffic.
According to the same legislation, the movement of vehicles should be carried out by the drivers or by any other person who holds a valid and valid driving license, as well as insurance coverage, at the driver's order.
Before moving the vehicles, the drivers involved must immediately inform their insurance companies about the cause of the road collision and exchange the following details with each other:
1. Their names
2. The numbers of their insurance policy certificates
3. Their driver's license numbers
4. Their vehicle details (registration numbers, make, type and color) and
5. Their phone numbers.
In addition, drivers should quickly take photos from the scene of the road collision, which include:
◗ motor vehicles in their final position after the road collision
◗ the registration numbers of the vehicles involved
◗ the damage caused and
◗ the surrounding area.
Also, drivers should exchange the photos taken with each other and send them to a person indicated to them by their insurance company or to a representative of the company.
In the event that any driver involved is unable to take photographs, he may request that the photographs be taken by any other person involved or by a person of his/her trust or a representative of his/her insurance company or a person indicated by it.
Drivers should take measures to ensure that both the photographs and, more generally, the data exchanged are appropriate, relevant and limited to what is necessary for the purposes for which they are processed.
The provisions of the legislation on the movement of vehicles do not apply in the event of a road collision involving an uninsured or government vehicle or in the event that any driver leaves the scene of the road collision.
