Until the end of the investigations, 48,430 documents of the Central Prisons that were found in the possession of a chief guard last April will remain in the hands of the Police.
This is what the Supreme Court decided, rejecting a request by the chief guard himself to be given permission to request the annulment of the order for the retention of presumptions, including thousands of state documents.
As clarified by the decision of Supreme Court judge Lena Dimitriadou - Andreou, the documents were found on 9/4/2025 at the home of the chief security guard as part of an investigation into another case. Specifically, in two locked rooms, one on the ground floor and one on the 1st floor, the Police found 48,430 documents, which consist of 250,464 pages, which were confiscated (the final number emerged after evaluating the documents). As stated in the decision, all the documents that were seized were illegally and without any authorization by the Applicant.
Among the documents are architectural, topographical and spatial plans of the Central Prisons in Nicosia, copies of convict files, documents for disciplinary investigations of the Prison Department, internal letters, reports, notes, tables – lists related to service matters of the Prison Department. Furthermore, it was found that documents from the Police and other state services were illegally and without any authorization in his home.
In particular, copies of Police documents related to various service issues of the Police, documents of other state services, Police correspondence with the Prison Department and correspondence exchanged between the Central Prisons and other state services and state officials were found. Several of the documents are classified CONFIDENTIAL. In addition to the documents, digital discs bearing handwritten notes with dates, a number with computer floppy disks, commemorative gifts and other items were found and confiscated.
The large volume of documents as well as the nature of the objects found, created reasonable grounds for believing that criminal offences had been committed in addition to those for which the search and arrest warrants had been issued. Therefore, they were confiscated in the presence of the Applicant and transferred to the offices of the Business TAE for further inspection and evaluation.
The prison guard's lawyer, Alexandros Clerides, had argued in his request that the District Court issued the present order for the retention of the presumptions, in excess of jurisdiction. He argued that the evidence at the time when the Police requested the issuance of the Decree was in its possession illegally, since the previous Decree dated. 14/4/2025 was annulled by decision of the Supreme Court dated. 11/7/2025.
According to the Supreme Court, the Court's discretion to issue an order for the retention of property found in the execution of a search warrant, which is not mentioned in that warrant, presupposes the existence of reasonable cause to believe that a criminal offence has been committed in relation to that property. The reference in the Affidavit to the identification, following a search carried out inside the Applicant's home, of a large number of official documents of the Prisons, including architectural, topographical, electrical, etc. plans of the Prisons, I do not believe that it could not objectively establish the required "reasonable cause" to believe that the criminal offenses mentioned above were committed. The opposite position put forward by the Applicant for the absence of "reasonable cause" is not at all consistent with the data that had been put before the Lower Court, the judge found.
"The essence of the matter and what matters, the Court concludes, is that, regardless of the fact that it was registered with the same number, the application that led to the issuance of the Detention Decree in question, taking into account its content, constitutes, in fact, a new application, independent of the previous one, based on the facts recorded in the affidavit supporting it. For the above reasons, I am not satisfied that there is a prima facie case and/or debatable to grant the requested license."
