COURT DECISION - THE RECORDING OF A VIOLATION BY A MOBILE CAMERA IS IN ACCORDANCE WITH THE LAW

The Nicosia District Court ruled that the recording of exceeding the speed limit by a portable photo-marking device was done in accordance with the law, sentencing on September 5 a citizen who had denied guilt for the violation.

According to an announcement by the Legal Service, issues related to the Traffic Offences Law of 2001 were examined, including the handling and operation of mobile cameras, the recording process, the service of a notice of an out-of-court fine, the protection of personal data, but also the fact that only the rear of the vehicle and not the driver's face was visible in the photo of the violation.

The Court concluded that the photograph met the legal requirements, as the law alternatively allows the presentation of a photograph of the vehicle at the time of recording. In addition, the service of the out-of-court document by registered letter was deemed lawful.

The decision states that the accused, although the owner of the vehicle, did not send the driver's details within the deadline, as he should have, nor did he provide any testimony that raises doubts as to whether he was at the wheel himself.

"The Prosecution cannot know further information about the driver, which only the owner can know," the Court notes, underlining that the general questioning of the accused was not sufficient to overturn the accusation.

As a result, the defendant was found guilty as the owner and driver of the vehicle that violated the speed limit. The case was handled on behalf of the Attorney General by the Public Prosecutor Georgia Sophocles.
