THE COURT 'FREEZES' THE MOVES OF INTRAKAT FOR THE PAPHOS-POLIS ROAD

Filenews 23 April 2025 - by Angelos Nicolaou

A decision in favour of the Republic of Cyprus was issued by the Paphos District Court on 11 April 2025, accepting the Attorney General's application for interim injunctions against the contractor INTRAKAT, in the context of the legal dispute concerning the construction of Phase A of the Paphos – Polis Chrysochous road.

Based on the decision, which validates the interim decree issued on December 3, 2024, INTRAKAT is prohibited from removing documents, studies, materials and other data related to the project from the construction site. The application was filed by the Attorney General on November 22, 2024.

The court ruled that the contractor's objections were not valid and found that there was both a legal and a factual basis for the issuance of the decree. In addition, the allegations of legal omissions or irregular procedure, as well as the allegation of "multiplicity of procedures" and abusive recourse, were rejected due to the pending of another case.

Nor was INTRAKAT's allegation of concealment of essential facts, which, in its view, could have influenced the court's judgment at the time of the issuance of the interim order.

In the decision, special reference is made to an affidavit filed by the Republic, in which delays and violations of the agreement on the part of the contractor are recorded.
