Filenews

Towards its end is a criminal investigation ordered by the Independent Authority for the Investigation of Allegations and Complaints against the Police, concerning a citizen's complaint against a police officer for pulling a service pistol.

The incident happened last August in the district of Paphos and nothing had been announced. According to the complaint submitted by a citizen to AADIPA, two members of the Police had stopped his course on a motorcycle because he was not wearing a helmet.

The police officer informed him that he would issue him out of court for the helmet. He reportedly reacted strongly and did not receive the out-of-court document, resulting in a momentary incident. Then the constable informed him that he was under arrest because of his reaction, tried to put handcuffs on him, he allegedly resisted resulting in an appeal.

Then the other police officer who was at the scene allegedly recovered his service weapon resulting in the citizen complying and ending the momentary incident. He even received the extrajudicial document.

After that, he filed a complaint with AADIPA for the fact that a constable recovered a gun against him. Initially, the Independent Authority decided and appointed as criminal investigator a lawyer from Pafos who began taking statements to investigate the citizen's complaint.

She subsequently withdrew from the case and the Authority appointed another person as a criminal investigator. According to "F" information, the investigation is ongoing and the question is whether the police officer had the right under the circumstances to retrieve his service weapon.

According to a police provision, members of the Police who carry out traffic police checks are prohibited from using their service weapons. The investigation will show whether the incident justified the constable to draw his service weapon to intimidate the citizen or not.

Under police regulations, the use of a service weapon is made when lives or property are in danger and there is no other way to protect them, or when the constable feels that he is in danger himself and is in self-defense.
