LABOUR CENSUS STARTS FROM TODAY

The census of all employees, their salaries and terms of employment in Cyprus starts today, with employers having two months at their disposal!

The aim is to record in real time the situation in the labour market, a development that will in turn facilitate inspections by the Ministry of Labour of labour legislation, but also the fight against undeclared work.

The relevant decree of the Minister of Labor Yiannis Panagiotou was published in the Official Gazette of the Republic on December 20 and records the terms of employment of each employee that employers must register in the electronic system "ERGANI", which is already used by the Ministry of Labor and businesses for recruitment registration.

According to the decree, each employer is obliged to register the essential terms of employment of all its employees in the information system "ERGANI" between January 2, 2025 and February 28, 2025.

What are the conditions for registration in the electronic system "ERGANI"?

Employers and businesses will have to register a total of 15 terms of employment, such as payroll and working hours, about which employees must also be informed by their employers no later than seven days after they are hired.

Specifically, according to the Ministerial Decree, the essential conditions for registration in the electronic system "ERGANI" are the following:

  • Employer details
  • In the case of a retail business, the type of business
  • Employee details
  • Employer's details
  • Place of work under the employment contract and place of work at the time of registration
  • Job description and employee specialty
  • Task start date
  • Task finish date for fixed-term work
  • In the case of temporary employment agencies, the details of the indirect employer
  • Terms and duration of probationary period
  • Duration of annual leave and method of reimbursement
  • Remuneration – salary, frequency of payment (daily/ weekly/ monthly/ hourly)
  • Normal working day/week hours
  • Report if employee hours are unpredictable
  • Other benefits/allowances, commissions, indexation allowance, etc.

According to the Ministry of Labour, "the obligation of employers to register the terms of employment of their employees in an information system is now explicitly included in the provisions of the legislation and the Minister of Labour and Social Insurance is empowered to issue a decree setting out the procedural arrangements concerning the implementation of this obligation of employers".

A key objective of the new legislative framework is to make tackling undeclared work, which creates a host of negative problems, more effective.
