A 41-year-old woman was sentenced yesterday with an 18-month prison sentence for causing the death of the unfortunate motorcyclist, Savvas Gamvroudiou, 28 years old from Limassol, in a road accident that occurred on the evening of August 29, 2021 at the junction of Omonia Avenue with Vasileos Pavlou Street.
The 41-year-old defendant from Moldova, although initially denied the charge of causing death by reckless, reckless and dangerous act, in the end, before the hearing began, she changed her stance and admitted. Following this development, the Limassol District Court, and in particular, Judge Doria Varosiotou, imposed an 18-month prison sentence on the defendant, who was taken by the Court to the Central Prison. All this time, the 41-year-old was free on parole.
The fatal collision occurred at 23.15 in the evening of August 29, 2021, when the large displacement motorcycle driven by the 28-year-old on Omonia Avenue in a northerly direction, collided with a car driven by the defendant. According to the facts of the case, the accused driver while parked outside a kiosk, on a double yellow line, started while perceiving the light of the victim's motorcycle from afar.
Hurriedly and within 3 seconds, without taking into account the distance and speed of the 28-year-old, she decided to take a risk and enter the lane right, ignoring the risk of collision, thinking that she had time and that nothing would happen. The defendant entered diagonally on the avenue, made a right turn towards Vasileos Pavlou Street while in her haste she did not use the right turn signal, thus stopping the path of the unfortunate young man who found instant death.
According to the findings of the examinations carried out by the Traffic Police, when the accused started her vehicle, the victim was 91 meters behind, with the headlights of his motorcycle on and the traffic light was visible. The maximum visibility the defendant had from where her vehicle was parked was 235 metres to the rear, in a straight line, with the Court noting that there was very good lighting along the avenue.
When imposing the sentence, the Court took into account the victim's driving behaviour and that he was driving at 121 km instead of 50 km which was the limit and that he was driving a large displacement motorcycle without having a driving licence for this type of motorcycle. As mitigating factors, the 41-year-old's clean criminal record was taken into account and the Court was deeply concerned that the defendant is a single parent and has sole custody of a 14-year-old child.
It is noted that for this avenue a request has been pending since 2009 to the competent Ministries and Services for the construction of a separating built island, however, the request has been stalled for years. It is a busy and commercial road which is used daily by thousands of drivers since it is the vertical road leading to the new Limassol Port.
The case was handled on behalf of the Attorney General by public prosecutor Konstantina Hadjikonstantinou.

A five-and-a-half-year-old child was responsible for the latest Limassol fire, it was reported on Tuesday.
Speaking on CyBC, police spokesman Christos Andreou said the facts of the case emerged after police persisted in their interrogations at the fire’s point-zero, following its outbreak shortly after 11am on Monday.
According to Andreou, the mother of the child had initially fabricated a story about having seen a pickup truck driving away from the site, even going so far as to offer a description.
When pressed at the Episkopi police station later, however, she confessed that her child had been playing with a lighter unbeknownst to her and had started the fire.
The blaze ended up destroying around five hectares of wild vegetation and pine trees near the villages of Souni and Zanakia, and burning a generator, a house and a car belonging to a 77-year-old man.
Five aerial means, the forestry department, the civil service, and British bases personnel needed to be mobilised to extinguish it.
The mother has been charged in writing for falsifying information to police and for negligence which led to her child bring in possession of a dangerous item, Andreou said.
Episkopi police are furthering the investigation.
