Filenews

Answers from the autopsy on half of the body found on Monday afternoon in a state of advanced decomposition in a rocky area of Agia Thekla in Sotira, investigators of the case are seeking.

The autopsy will be performed by forensic pathologists at 11:30 at Nicosia General Hospital, in the presence of an anthropologist, in order to determine gender, age, as well as the time of death. Initial indications suggest that the body belongs to a woman who died four to five months ago and that it may have washed up from the sea.

These clues, according to philenews, give a first direction to the investigations by crowning them in a shipwreck with migrants that occurred a few months ago. As early as last January, some bodies washed up in the occupied areas and it is being investigated whether they are linked. DNA samples will be taken from the body and sent to Syria and Lebanon, police sources told us, in an effort to determine if it belonged to a person on the boat. However, until it is ascertained what happened, all scenarios will remain open. Police spokesman Christos Andreou told CNA that the body was found by a citizen at 2 p.m. yesterday.

"The scene was immediately cordoned off by members of the police and tests carried out revealed that it was a human corpse, from the waist down and that it was in a state of advanced decomposition," he said. Andreou said that "it has not been clarified whether the body washed up from the sea, but the most serious indications indicate that this was done.

From the first moment, the Port and Maritime Police was informed, members of which began patrols and examinations in the sea area, in order to identify possibly other findings that could help investigators identify the body and the causes of death." Asked whether the body may belong to an irregular migrant, Andreou replied that "nothing is excluded, all possibilities are open. From the indications that exist, the body must have washed up from the sea, but this will also be determined by the tests that will be done."

He added that "the advanced decomposition in which the body was found and the fact that the body was not complete, certainly complicates the work of forensic experts, anthropologists and investigators examining the case."

The Court of Appeal reduced by two years the sentence imposed on the 54-year-old Russian for causing the death of 27-year-old Panagiotis Christoforou in 2019 as a result of a horrific accident.

The Russian driver was sentenced by the Limassol Permanent Assize Court to nine years in prison after finding him guilty of murder under Article 205 of the Penal Code.

According to the facts, on 28.11.19 at about 00:38 on the Nicosia-Limassol motorway just before the exit of the village of Mouttayiaka, a fatal accident occurred with victim Panagiotis Christoforou, aged 27, father of a minor child. The appellant was driving his BMW car and collided with the rear of the SUZUKI car in front driven by the victim.

It was found that the proportion of alcohol in his blood was 246 milligrams of alcohol to 100 millilitres of blood, while the upper limit set is 50 millimetres, which is considered too high and has a sedative effect.

This, combined with taking pills that should not have been consumed with alcohol, led, as was the finding of the Assize Court, that the 50-year-old was not in control of himself and was not fit to drive.

On a number of grounds, the convicted man complained in his appeal that the sentence imposed on him was excessive, while asking for acquittal on the charge of manslaughter.

The Court of Appeal (Criminal Procedure), after analyzing all the grounds of appeal, held that in cases of unintentional homicide there is a variation in the imposition of sentences in the case law and depends on the facts of each case.

Having regard to the facts of the present case, the Court of Appeal states, as well as the circumstances of the commission of the offence of homicide as described in our sentencing decision, we consider that these circumstances fall within the scope and range of sentences that jurisprudence has set as conditions of involuntary homicide.

"Given that the present case concerns involuntary homicide and taking further into account all the mitigating factors relating to the person of the appellant, objectively judged these do not reflect the sentence imposed. Therefore, the sentence of 9 years is considered manifestly excessive and is replaced with a sentence of 7 years imprisonment. The appeal against the conviction is dismissed. The appeal of the sentence succeeds," the Court of Appeal concludes.

The two youths aged 17 and 18, who were injured in a road collision in Ayia Napa, were not wearing protective helmets, with the 17-year-old motorcycle driver being treated in critical condition in the Intensive Care Unit of Nicosia General Hospital.

Steve Theodoulou, spokesman for the Famagusta Police Department, said: "At around 10.30pm on Sunday 21 April, a road collision occurred in Ayia Napa. According to the information before the Police, a motorcycle driven by an 18-year-old from Ayia Napa, on Cape Greco Avenue in the direction of Ayia Napa, having as a passenger a 17-year-old from Paralimni, at some point on the road, by the turn to Kryo Nero, under circumstances that are being investigated, lost control of the motorcycle and as a result it overturned".

He added: "Both youths were injured in the collision, the most serious being that of the 17-year-old passenger. The 18-year-old driver was taken to a private clinic in Ayia Napa and was found to have rib fractures and abrasions on various parts of his body and was detained for monitoring of his condition."

The 17-year-old passenger "was transported by ambulance to Famagusta General Hospital in Paralimni where he was found to have a severe traumatic brain injury and after being intubated he was transferred to the Intensive Care Unit of Nicosia General Hospital, with his condition classified as critical."

As Mr. Theodoulou said, "the 18-year-olddriver was given an alcohol test with zero indication as well as a drug test with a negative result. Police investigations found that the two youths were not wearing a protective helmet, while the 18-year-old was not a driving license holder and was not covered by insurance."

The scene was designed and photographed by members of the Famagusta and Ayia Napa Traffic Police.

The cause of the collision is being investigated by Ayia Napa Police Station.

The Independent Authority for the Investigation of Allegations and Complaints against the Police (AADIPA) will appoint two criminal investigators tomorrow to examine the circumstances of the death of the 24-year-old foreigner, who fell from the 5th floor of an apartment building in Limassol.

According to philenews, the Authority decided at a meeting last week to seek the approval of the Attorney General to proceed with the appointment of criminal investigators.

At the same time, on the same day, a complaint had arrived – after taking its decision – from KISA requesting the appointment of criminal investigators.

According to the same information, the Attorney General has given his approval and tomorrow two criminal investigators will be appointed to investigate the circumstances under which the 24-year-old from Bangladesh was found in limbo, while members of the Aliens and Immigration Service of the Police attempted to search the apartment where he lived.

The Authority has already taken a decision to appoint a lawyer and a former police officer from a list to carry out the investigation as criminal investigators.

Following this development, the police investigation conducted by the ICF of Limassol was suspended. In fact, all statements taken by police investigators and any evidence collected must be handed over to criminal investigators.

The unfortunate 24-year-old was found dead last Wednesday after police raided the apartment in which he was staying with 11 other foreigners. They are looking into the conditions of his stay in the apartment, whether he was employed illegally and why the police went to check without a search warrant.
