The Nicosia Assize Court found two defendants guilty yesterday of trafficking for the purpose of exploitation for sexual purposes, while for the first time a client was convicted of using the services of an exploited victim. A third person was acquitted of two attempted rapes of the same victim, but was convicted of making threats against her.
This serious case was investigated by the Police's Anti-Trafficking Office in 2021 and after a lengthy court hearing after the three involved did not plead guilty, yesterday the conviction was handed down. The victim was an 18-year-old girl, while the three defendants were all from Romania. The decision of the Assize Court was catapult since it found the first defendant guilty of all the serious charges he faced, namely: trafficking of a minor for the purpose of sexual exploitation, trafficking of an adult for the same purpose (it is the same girl), trafficking of an adult person and exploitation of her vulnerable position and illegal retention of her personal data (identity etc. objects). At the same time, he was convicted of pimping and assault and threat (he was accused of grabbing the victim by the throat).
As for the client, he was convicted of using the services of an exploited victim and of rape. As reported in court, although the complainant consented to some kind of sexual act, she was opposed to having sex without using a condom.
As for the third defendant, he was acquitted and acquitted of attempted rape charges (two charges) while he was found guilty of sending threatening messages to the 18-year-old, which were sent after she reported the case to the police. Following this ruling, the Assize Court ordered that the Romanian man facing trafficking charges and the client remain in custody (until now they were free) while the third defendant remains free.
The Assize Court set the case for today for speeches by their lawyers for mitigation of the sentence and it is expected that tomorrow they will be sentenced, as the court will then be dissolved due to judicial reform and the promotion of some judges to appeals. It is the first time that a client who "buys" sexual services from a victim of trafficking has been convicted by the court. The case on behalf of the Legal Service was handled before the Assize Court by the senior lawyer of the Republic, Christia Kythreotou.
