LAND REGISTRY - SAMPLES OF PROXIES AVAILABLE ON THE INTERNET PORTAL

Samples of proxies were posted on its Internet Portal (Land Registry Portal), the Department of Lands and Surveys (TKX).

The Director of the TKX said that "the absence of samples created a gap and inconvenience for ordinary citizens" and added that "for their convenience, the samples have been posted in Word document format, so that citizens can edit them and / or vary their content as they wish, depending on the case".

He said that these documents are listed as auxiliary models and the Department of Lands and Surveys is not responsible for their use.

"But they were deemed to be very useful to the citizens and will facilitate them in their legal transactions in the Department," he added.

Mr. Elias urged citizens, before signing any General or Special Power of Attorney Document, to be particularly careful about its content and to be aware of the consequences created by signing this document.

"Those who sign a power of attorney are required to do so of their own free will, to be in good health, to be in mental and spiritual sobriety and generally not to be subject to any legal exception regarding their legal capacity," he stressed.

In addition, he said that they should have detailed information and sufficient knowledge on the issues to which the power of attorney refers.

The Director of the TCI also told the CNA that the authenticity of the signature of the Proxy Holder on any General or Special Power of Attorney Document must be duly certified by a certifying officer, in the presence of the transacting party, in accordance with the provisions of the Annex of Law 165(I)/2012.

In addition, he said that the document on which the signature or seal is certified by the certifying officer should be stamped, in accordance with Article 34 of the Stamp Duty Law No. 19 of 1963 and the Amending Laws 38/72 and 173/(I)/2012.
