PENALTIES FOR NOT ACCEPTING CREDIT CARD PAYMENTS

Up to €2,000 fine and conducting checks for implementation of the decree for obligation to accept means of payment with a card announced the Department of Taxation.

The Department of Taxation informs that, based on article 30A of the Tax Assessment and Collection Law, businesses that are listed in the annex to the relevant Decree of the Code of Public Law 259/2021, ("Liable Parties") should accept card-based means of payment in the context of their transactions with consumers for the completion of payment transactions.

Implementing Directive 20 of the Department of Taxation is also relevant.

On the basis of the above, the Department of Taxation intends, in October 2021, to carry out audits to confirm the implementation of the Decree.

Deadline for the implementation of the Decree

Existing businesses must comply with the Decree by 18/9/2021.

For businesses that have been active during the last thirty (30) days before the expiry of the compliance deadline, the implementation of the Decree is extended until 18/10/2021.

Businesses that become "Liable" for accepting means of payment with cards, after the implementation of the Decree (after 18/9/2021), must comply within one (1) month from the date on which they become "Liable".

Informing consumers about the acceptance of card-based payment instruments

Businesses which have an obligation to accept card payments must inform consumers in a clear way that cannot be misinterpreted, by posting relevant information at the entrance of the premises and at the cashiers.

Administrative fine for violation of the provisions of the Decree

In case of a violation of the provisions of the Decree, an administrative fine of up to €2,000 is imposed on the basis of article 50F of the Law.
